Expanded Emergency Declaration Under 49 CFR § 390.23 No. 2020-002 (Relating to COVID-19)
Parts 390 – 399 of the Federal Motor Carrier Safety Regulations Exempted for Commercial Motor Vehicles Providing Direct Assistance Related to COVID-19

The Florida Division of Emergency Management (FDEM) and the Florida Department of Highway Safety and Motor Vehicles (FLHSMV) are pleased to share the following information from the Federal Motor Carrier Safety Administration in regards to the transportation of COVID-19 supplies:

Through August 31, 2021, the Federal Motor Carrier Safety Administration is continuing the exemption granted from Parts 390 through 399 of the Federal Motor Carrier Safety Regulations in response to COVID-19. This provides regulatory relief for commercial motor vehicle operations providing direct assistance in support of emergency relief efforts related to COVID-19.

The items that this exemption is related to includes:
  • Livestock and livestock feed
  • Medical supplies and equipment related to the testing, diagnosis and treatment of COVID-19
  • Vaccines, constituent products and medical supplies and equipment including ancillary supplies/kits for the administration of vaccines,
  • Supplies and equipment necessary for community safety, sanitation, and prevention of community transmission of COVID-19 such as masks, gloves, hand sanitizer, soap and disinfectants
  • Food, paper products and other groceries for emergency restocking of distribution centers or stores
​This exemption also includes exemptions to hours of service for drivers, allowing drivers to drive longer durations to deliver important COVID-19 resources.

FDEM and FLHSMV are encouraging drivers who are providing direct assistance in support of emergency relief efforts related to COVID-19 to read through the expanded modified Emergency Declaration No. 2020-002. The transportation of these supplies plays a vital role in delivering these critical supplies to hospitals, local governments and retail locations.
